Directors are appointed to Brazil’s National Data Protection Authority
The first directors appointed by the President of Brazil to the National Data Protection Authority (ANPD – Autoridade Nacional de Proteção de Dados) were announced on October 15, 2020.
The appointees are:
Waldemar Gonçalves Ortunho Junior, the current CEO of Telebras, appointed as President of the ANPD, for a term of 6 years;
Arthur Pereira Sabbat, currently a director of the Institutional Security Chamber’s Information Security Department, as a Director of the ANPD, for a term of 5 years;
Joacil Basilio Rael, a computing engineer and professor, as a Director of the ANPD, for a term of 4 years;
Nairane Farias Rabelo Leitão, a lawyer, as a Director of the ANPD, for a term of 3 years; and
Miriam Wimmer, currently a director of the Ministry of Communications’ Telecommunications Services, as a Director of the ANPD, for a term of 2 years.
The composition of the ANPD indicates a possible interest bringing together the goals of personal data protection and information security.
The appointees will now be reviewed by the Senate, and once approved, the ANPD will finally begin to operate.
The ANPD is a fundamental to the personal data protections established by the General Data Protection Law (LGPD – Lei Geral de Proteção de Dados Pessoais), since much of the legislation requires regulations.
The challenges to be faced by the ANPD include regulations on documents for international transfers of data, the definition of what is a “reasonable period” for communicating a security incident, and interoperability standards for data portability, among many other matters.
