Regulations are issued on Brazil’s National Intellectual Property Strategy
Twelve months after the Ministry of the Economy announced the National Intellectual Property Strategy ("IP Strategy"),1 Decree 10.886/2021, published on December 7, 2021, issues regulations on actions under the IP Strategy for the period 2021-2030.
According to the Decree, over the next 10 years a series of actions related to intellectual property ("IP") will be carried out, following the strategic guidelines established by the IP Strategy, which include (i) dissemination, education and training in IP, (ii) modernization of the legislative and regulatory frameworks, (iii) intelligence and future outlook, and (iv) Brazil's integration into the global IP system.
Key indicators will be used in the two-year projections that will support implementation of IP Strategy, such as the Global Innovation Index,2 global statistical data furnished by the World Intellectual Property Organization ("WIPO"), and national statistics provided by the Brazilian Patent and Trademark Office ("INPI"), along with studies on the economic contribution of IP-intensive sectors and on industry's strategies for protection of innovative assets.
As a result, the IP Strategy can be expected to promote use of the IP system as a competitive tool for industry, stimulating innovation and supporting economic advances in Brazil.
The Interministerial Intellectual Property Group (GIPI – Grupo Interministerial de Propriedade Intectual) will be responsible for implementing, monitoring and coordinating the actions under the IP Strategy. Formed in 2019, the GIPI is composed of representatives from various ministries, such as Health, Agriculture and Supply, and Science, Technology and Innovation.
The IP Strategy represents an important instrument for coordinating and integrating policies related to intellectual property, aimed at improving Brazil's competitiveness on the international scene. As the IP Strategy is implemented, we look forward to an increase in technological production and in patent applications, which will strengthen Brazil's patent system.
