Brazil’s Senate approves the Directors appointed to the National Data Protection Authority

On October 20th, the Federal Senate approved the Directors appointed by the President of Brazil to compose the first Board of Directors of the National Data Protection Authority (ANPD – Autoridade Nacional de Proteção de Dados).

Waldemar Gonçalves Ortunho Junior (President), Arthur Pereira Sabbat, Joacil Basilio Rael, Nairane Farias Rabelo Leitão and Miriam Wimmer were all confirmed as Directors of the ANPD, for terms ranging from two to six years.

Starting with the next appointments, the term of the ANPD’s Directors will be four years.

This was the last step needed before the ANPD could begin functioning. Given the many matters under the General Data Protection Law (LGPD – Lei Geral de Proteção de Dados Pessoais) that require regulations, the Board of Directors has its work cut out. 

It is important to remember that although the administrative sanctions under the LGPD will come into effect only on August 1, 2021, the Law is in force. A number of regulatory authorities are monitoring compliance, and the LGPD has already been used by data subjects to bring lawsuits to enforce their rights.
