Competition Advocacy

Competition issues are not confined to Brazil’s active and engaged antitrust authority, CADE – they come up frequently in other regulatory contexts and other public authorities.

Drawing on decades of experience in the competition law arena, our team helps clients make effective contributions to regulatory discussions and initiatives, ensuring that public authorities are aware of the impacts on competition that regulatory frameworks and practices can have.

Our competition practice is built on years of advising clients from a broad range of sectors in merger reviews and anticompetitive conduct investigations before CADE, which often involve highly complex economic issues.

Our in-depth knowledge of both competition law and competitive dynamics in different sectors allows us to propose sophisticated analyses of complex regulatory problems, which can give public authorities a better understanding of the competition impacts of regulatory choices and public policy design.

Our team provides support to clients interested in playing a part in regulatory reviews and reforms, taking advantage of opportunities to debate and mitigate potential competition distortions that can result from sector regulations and public policy design.

Requests for comments. We provide support to businesses and third-sector organizations of all sizes and sectors in Requests for Comments (Tomadas de Subsídios) made by public authorities of various kinds, including preparing studies and submissions to highlight the competition aspects of the matter under study.

Regulary impact assesments (RIA) and Regulary outcome analyses (ROA). We provide support to businesses and third-sector organizations of all sizes and sectors in engaging with public authorities on competition matters included in Regulatory Impact Assessments (RIA) and Regulatory Outcome Assessments (ROA) mandated by legislation.

Public consultation. We provide support to businesses and third-sector organizations of all sizes and sectors in preparing studies and submissions on the competitive impacts of draft sector regulations and policies, working to identify and mitigate market distortions and anti-competitive outcomes.

Regulatory and competition assessment procedures (PARC). The main objective of the PARC initiative led by the Economic Reform Secretariat of Brazil’s Ministry of Finance is to identify and evaluate the anticompetitive effects of regulation of economic activity. We provide support to businesses and third-sector organizations of all sizes and sectors interested in identifying regulations for evaluation under PARC and submitting suggested changes.
